Wow. No one has posted in here in a whole month. So much has happened / is happening on the legal front in the several criminal and civil cases against t——. I don’t post about every day-to-day occurrence but the last couple days deserve notice.

This post focuses on Fulton County, Georgia District Attorney Fani Willis’ RICO [racketeer influenced and corrupt organizations] criminal case against t—— and 18 co-conspirators. Two important, high-level co-conspirators just pleaded guilty, aka they flipped!

I’ve heard criticism that Powell and Chesbro have been treated too leniently in relation to the seriousness of the crime, attempting to overturn an election, undermining our democracy. Their penalty? Probation, no jail time, and a puny fine. The plea deal requires that they testify to all that they know. I’ve read that the way these plea deals go, the ones who admit guilt early in the case receive greater leniency. Also, the lure of a lenient sentence may induce others to flip and spill the beans.

Former president Trump is shouting very loudly today that Sidney "The Kracken" Powell was never his lawyer. On the one hand, I can't blame him. Who'd want to be associated with that crackpot?

But on the other hand - and there is ALWAYS an other hand in this deal - if The Kracken was never his lawyer, then there can be no attorney-client privilege. And while The Kracken might not have been Trump's lawyer, she was definitely on his team. She was in the room on many important occasions. If she's not his lawyer, then keeping her testimony out just got impossible.

Former president Trump probably should have kept his mouth shut but I don't think that's something he's capable of.

As many people have pointed out to me, the crime/fraud exception may have already removed any and all alleged attorney/client privilege.

I hope so. Even in that tweet above, Trump says "our" lawyers - not "his". He'll parse that to the nth degree.

That dude from Australia that Trump apparently spilled lots of classified info to said Trump would do it like this - :Go tell that guy to stop stealing" and then in there was a kerfuffle, he would say, "Hey - I never told that guy to stop stealing". Weak sauce, but that's the way the guy seems to work.

But that only takes you so far. At the end of the day, a smart lawyer is going to ask him, "I know you didn't tell the guy to stop stealing. But did you ever direct anyone else to tell him that?" Ultimately, you can't get away from your own words.
 
a 4th co-conspirator in the Georgia election fraud case flips: Jenna Ellis!!!

I have never felt sympathetic towards Jenna Ellis till I heard it said that, unlike Sydney Powell, who apparently has a long and distinguished career as an appellate lawyer in Texas and ergo amply padded saddle bags, Ellis is young, inexperienced, financially strapped. Powell has a very light sentence (no felony, I believe) and will walk into one of her expensive, comfortable homes and rest on her laurels and be feted by the Texas elite. Ellis, on the other hand, has a felony conviction. Maybe she's being genuine when she makes her tearful statement. Watch the recording in the article linked to below.

Somewhat unrelated: I listened to a podcast, Pod Save America, the other day that included an interview of Cassidy Hutchinson, Chief of Staff mark meadows' aide who testified before the Congressional Jan 6 committee. You remember her, no doubt. When I listened to Ellis just now I was reminded of that interview... Christian, 'conservative', young republicans, caught up in the swirl of events; pretty, eye-catchers who served a purpose.

And then I listened to a podcast with Mary Trump and Jessica Denson on Denson's show 'Lights On'. They had exactly no sympathy for Ellis and say that after making the tearful statement in court, the next public interaction she had was to post about Hunter Biden's laptop on social media. So, basically, all the contrition was by an actress still intent on deceit. Denson is a former staffer for the 2016 t---- campaign who won a court case involving an NDA she signed, after speaking out about workplace harassment. I had never heard of her. She is now a never-t----er. Basically, veering off the topic at hand (Jenna Ellis), here's a link to that show, just cuz I mentioned it.

There's actually very little about the NDA in the video. Denson is interviewing Mary Trump. The description reads, "Lights on! mark meadows flipped in the DC Jan 6 case?!!!! and testified before Jack Smith, the special prosecutor???

I’ve seen this reported several times yesterday and was wondering why I was feeling confused. I just looked at the list of topics in the p&r forum and discovered that mdiver created a new post about mark meadows flipping back in June 2023 when it was rumored. I guess the hullabaloo now is due to its being confirmed.

t—— and his current defense lawyers’ shenanigans continue. Today, the topic is cameras in the courtroom in the DC case brought by special prosecutor Jack Smith with Judge Tanya Chutkin presiding. This is the case focused on t——‘s efforts to overturn the 2020 election in Washington, DC.

Here is Glenn Kirschner, former federal prosecutor who has had a daily podcast, Justice Matters, these last several years. Since 2020 or maybe 2021, he has reported daily on the pursuit of justice as concerns former president t——. He ends every post with the words, “… because justice matters.” I like to listen to him because he knows the law and because, as a professor, he explains legal proceedings very clearly and because he has reported daily on what is happening since early on, beginning w the frustration of waiting for the Justice Department to take any action at all. He very sincerely reports on the unfolding legal process as concerns the criminality of and the threat to our democracy that is d——- t——.

Here, below my chit-chat, is a clip by young lawyer, Brian Taylor Cohen, who I’ve seen before because he and Glenn Kirschner sometimes team up to do a segment together. This video was served up by the YT algorithm, on the heels of the previous clip. They complement each other. This one focuses on the case in Georgia, brought by DA Fani Willis in a civil case, the RICO case involving numerous defendants, several of whom have recently flipped. Cohen highlights the basic strategy t—— and his lawyers are pursuing now. Because the evidence is overwhelming, they are focused on undermining public confidence in the justice system and process itself. That is the same strategy that prompted the motion reported in the first clip too, above. Here, below, in Cohen’s post, he shows that, in the Georgia case, the evidence is similarly overwhelming, especially now that Sydney Powell and Jenna Ellis are speaking openly about what took place in the multi-pronged effort to overturn our democracy.

t—— has been claiming he’s being treated so unfairly for a while. We’ve seen it in the NY civil case proceedings brought by AG Letitia James with Judge Engoran presiding, the case involving business fraud at the Trump Organization, in which t—— and his 3 eldest children have been on the witness stand these last couple of weeks. Whenever t—— gets into the hallway outside the courtroom, he immediately launches into his grievances to the waiting tv cameras.

wow... we haven't posted anything on this thread since November. At this point in time, there's a new event having to do with t----'s legal troubles every single day. It's interesting to follow what is going on. There's a legal education for the layperson if you try. Luckily, there are sites on the www with lawyers explaining the day's events. Much of the legal wrangling has to do with team t----'s efforts to delay - delay - delay. t----'s legal team challenge every ruling, every case. t---- meets the press outside the courtrooms, fabricates lies, makes verbal attacks against anyone associated with the court cases, no holds barred. Legal experts suggest that any ordinary defendant who conducted themselves in such a way would have a gag order imposed, and would very likely be jailed. Judges have been 'swatted', 'doxxed', etcetera. Judge Engoron's law clerk has been attacked through social media. It's become necessary to have 'anonymous juries', so that the jurors and their families remain safe from threats and attacks.

If you’ve been following the criminal case progress in Georgia, the RICO case concerning election interference in Georgia, involving some 18 defendants, you’ll know about the calls for removal of DA Fani Willis for having a romantic relationship with a prosecutor she hired to work on the case. From what I understand, such a relationship among lawyers working the same side of a case is not disqualifying. Nonetheless, the defendants, particularly t—— and his lawyers have seized the opportunity to make hay, to try annd have Willis removed and delay the start of the actual trial. Judge McAfee presides and presumably allows this circus to play out because doing otherwise might expose the case to claims of mistrial.

I watched this clip and thought it was interesting on a number of levels: (1) who her father is and his own life experience; (2) the asinine questioning as the attorneys for t—— and others searched for something to pin on the DA; (3) why DA Fani Willis’ had to leave the house she’d had built directly after being elected to her current position, basically due to racism and threats.

Yup. That’s George Conway of kelly-anne fame. May we never hear from her again. But! This is a great conversation w Karen Friedman-Agnifilo of Meidas Touch who, btw, was a top prosecutor in an important NY (federal?) court. I can’t recall which one but may make a correction here later.

Anyway, this discussion/commentary covers the progress of several of t——‘s legal cases: the civil trial in the E Jeanne Carroll case, in which she just won an award of some $83 million for defamation. The SCOTUS case/appeal(term?) of the State of Colorado’s disqualification of t—— from that state’s ballot. The Mar-a-lago national security documents case, with the barely new, t—— -appointed, still-wet-behind-the-ears judge cannon presiding. The election fraud (hush money) case brought by DA Alvin Bragg in NYC. Just great stuff from these lawyers. It feels like such a privilege to be able to listen in. Podcasts can be great. This one’s pretty good, even though some of the items discussed have progressed a little more since it was recorded.
 
Somehow, t---- is an absolute expert at pulling everyone else into his legal quagmire. Today, it's the Jan 6 case brought by Special Prosecutor Jack Smith, presided over by Judge Tanya Chutkan in DC.

Front and center right now is t----'s claim of 'absolute immunity' from prosecution for criminal acts made during his presidency. It's become a red hot issue. There isn't established legal precedent because we haven't had a former president under even one criminal indictment before, much less 4.

Way back in December 2023, Special Prosecutor Jack Smith asked the Supreme Court to take the case right away rather than punt to the DC appeals court. Smith knew the case would end up at scotus and wanted to take the quickest path to a final answer on the question. But no. . . scotus wanted to let the legal system take its course. Which it did. The appeals court took some time to write a comprehensive opinion against t----'s claim of absolute immunity. 57 pages, which covered every possible argument, so it's said. I haven't read it. Here it is, for your convenience.

Per usual, after the DC Appeals Court decision, t---- appealed to the Supreme Court. He always appeals. Weeks went by and pundits speculated that the thoroughness of the DC Appeals Court's ruling obviated the need for further consideration. Last week, to general surprise, scotus decided to take the case.

By taking up the question, the supreme court has delivered a huge political win to t---- and, consequently, a defeat to we, the people. Due to the timeline SCOTUS has outlined, we will not know the outcome of the Jan 6 case before the fall elections. Was that by design? With a 6-3 republican-dominated court and 3 appointees by d t----, it's possible. Which leaves anyone watching biting their nails. What decision will they hand down?

Noticing nothing’s been posted here since the 3rd. Oh. Of course stuff’s happened.

Like Judge McAffee (sp?) made a decision in the hearing about the romantic dalliance between DA Fani Willis and one of the prosecutors she picked for the case, Nathan Wade. How did I not post about that? The District Attorney will be allowed to continue but only if Nathan Wade is off the case. Commentators pretty much universally agreed that Willis made a mistake in indulging in the relationship, while at the same time insisting there was nothing wrong, legally, with what she did. There is no conflict of interest when 2 lawyers on the same side of a case (both being on the prosecution) have an intimate relationship. Some criticized the judge for allowing the hearing to devolve into a distraction and spectacle.

Which brings me to why I started this post in the first place: to post the following video about how our legal system works as compared to what might be found in other constitutional democracies, the pros and cons. One of the cons is that we have two very inexperienced judges officiating in 2 historically significant cases involving defendant d——- t——.

Wow. Last post in here was back in March. So much has happened since then. Now, w t0000 elected and the inauguration a mere ~42 days away, some of the legal cases against t0000 have been . . . dismissed isn’t the word. I don’t know the legal term. But anyhow , the cases involving Special Counsel Jack Smith are being wrapped (wan unlikely possibility of being revived at some future date, I think). Basically, it looks like the guy will never be held accountable for stealing classified documents of these United States to his domicile / club and then refusing to return them, etc or for his central role in the Jan 6 2021 events at the Capitol.

However, some of the state level cases, particularly those that have already been decided are still in play. Here’s an update on the civil fraud case in NY.
